Terms and Conditions

These Terms and Conditions (hereinafter "Terms") govern access to and use of the Scriptum software and the website scriptumwriterstudio.com, owned by Juan Manuel Cuenca Navarro, operating under the Scriptum brand.
By registering, subscribing to or using Scriptum, you accept these Terms in full. If you do not agree with any of these conditions, you must not use the service.
1. Definitions
- "Scriptum": the AI-powered writing software developed by Juan Manuel Cuenca Navarro, available as a web application (PWA) and a desktop application.
- "Aura AI": the AI writing assistant integrated into Scriptum. In both the web version (SaaS) and the desktop version, Aura AI operates on a BYOK (Bring Your Own Key) basis: the User connects their own API keys from third-party AI providers (OpenAI, Google Gemini, Groq, OpenRouter and, in the desktop version, also Anthropic/Claude or local models). Scriptum does not provide or include any AI credits, keys or usage allowance.
- "AI-Generated Content": any text, suggestion, correction or material produced by Aura AI or any AI service integrated into Scriptum, in response to instructions or text provided by the User.
- "User": any person who accesses, registers for or uses Scriptum.
- "Subscription": the paid plan contracted by the User (Scriptum Pro).
- "User Content": all text, images, files or material created, uploaded or stored by the User in Scriptum.
- "We": Juan Manuel Cuenca Navarro, owner of Scriptum.
2. Eligibility
To use Scriptum you must:
- Be at least 16 years of age (or the minimum age required in your jurisdiction).
- Have legal capacity to accept these Terms.
- Provide true, accurate and complete information during registration.
3. User account
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activities carried out from your account.
- You must notify us immediately of any unauthorised use of your account.
- You may not transfer, sell or share your account with third parties.
- We reserve the right to suspend or cancel accounts that breach these Terms.
4. Subscription plans
4.1 Available plan

The prices shown do not include VAT. Any VAT or other indirect taxes applicable in your country of residence are added at the time of payment (for example, 21% in Spain). Payments are managed by Lemon Squeezy (Merchant of Record), which calculates, collects and remits the applicable taxes in each jurisdiction, so the final amount you pay will include those taxes. We reserve the right to change prices with at least 30 days' prior notice.
The features listed in the table above—including PDF, EPUB and DOCX export without a watermark—correspond to the Scriptum Pro Subscription. During the free trial preceding purchase, the express limitations described in Section 4.4 apply.
4.2 Billing and payments
- Payments are processed through Lemon Squeezy (Merchant of Record), which securely manages billing, invoicing and tax remittance in each jurisdiction.
- The monthly subscription is billed each month on the date of purchase.
- The annual subscription is billed as a single payment at the start of the period.
- Failed payments will be retried automatically during a 7-day grace period.
- If payment is not completed after the grace period, the subscription will be suspended.
- Currency conversion: Lemon Squeezy processes charges in US dollars (USD). If your card or account currency is different from the dollar, your bank or card issuer may apply a currency conversion fee. This fee is outside Juan Manuel Cuenca Navarro' control, varies by institution and may not apply; we recommend checking your bank's terms.
4.3 Billing cycle change
- You may switch between monthly and annual billing at any time from your user dashboard.
4.4 Free trial
Upon creating an account, the User is granted a free trial of 3 calendar days, counted from the time of registration. The trial is activated automatically and requires no card or any other means of payment; accordingly, it gives rise to no charge and does not automatically convert into a Subscription when it ends.
During the trial, the User has full access to the application (editor, Aura AI on a BYOK basis using their own key, World Bible, visual planning, Font Studio, cover design and themes), with no limit on the number of projects, including the preview of the typeset book without a watermark.
The trial is subject to the following express limitations, which the User accepts upon registering:
- Files that the User exports in PDF format, as well as any cover images downloaded, carry a Scriptum identifying watermark. Export without a watermark is reserved for the Subscription.
- Export in EPUB and Word (DOCX) formats is reserved for the Subscription and is not available during the trial.
- Markdown and JSON exports (project backup) are available during the trial and carry no watermark.
The User undertakes not to remove, conceal, crop, alter or circumvent by any means the watermark embedded in the files exported during the trial, and not to distribute or publish such files presenting them as files generated under a Subscription. Breach of this obligation constitutes a breach of these Terms for the purposes of Section 7 and may give rise to the suspension or cancellation of the account.
Once the 3 days have elapsed, access to the application is suspended until the User purchases a Subscription; on logging in, the User will be directed to their account screen, from which the Subscription may be purchased. Expiry of the trial does not delete User Content: its retention is governed by Section 5.1 of these Terms and by the Privacy Policy. If the User purchases a Subscription, they regain access to their content in the state in which they left it.
The free trial is intended for a single use per person. We reserve the right to refuse or revoke the trial where abusive use is detected, such as the creation of multiple accounts for the purpose of extending it.
5. Cancellation and refunds
5.1 Subscription lifecycle and data retention
- You may cancel your subscription at any time from your user dashboard.
- Cancellation takes effect at the end of the current billing period.
- After cancellation, you retain access to all features until the end of the paid period.
- Your account will be automatically suspended at the end of the period.
- Your projects and data are retained for 30 additional days after the downgrade.
5.2 Right of withdrawal (EU)
Purchases are processed through Lemon Squeezy, which acts as Merchant of Record (seller and merchant of record). Accordingly, the sale, invoicing, refunds and the exercise of the right of withdrawal are governed by the Lemon Squeezy Buyer Terms, in addition to the applicable consumer legislation.
As a general rule, EU consumers have 14 calendar days to withdraw from an online purchase. However, since this involves digital content and services with immediate access, if you expressly request and consent to the performance beginning before that period ends, you acknowledge that you lose the right of withdrawal once performance has begun, in accordance with Article 16(m) of Directive 2011/83/EU. This consent is collected during the Lemon Squeezy payment process.
5.3 Cancellation
You may cancel your subscription at any time from your account or from the Lemon Squeezy customer portal. Upon cancellation, you will retain access until the end of the period already billed and no further charges will be made. Except for the right of withdrawal indicated above and the Lemon Squeezy policies, no refunds are made for the remaining portion of a period already started.
6. Intellectual property
6.1 Your content
Your creative content is YOURS. Always.
- You retain all intellectual property rights over the User Content (novels, chapters, characters, worldbuilding, etc.).
- We do NOT claim any ownership rights over your creative content.
- We do NOT use your content to train AI models.
- We do NOT share your content with third parties, except as strictly necessary for the operation of the service (e.g. sending text to the AI provider configured by the User to generate a response).
6.2 Limited licence
You grant us a limited, non-exclusive, revocable and non-transferable licence to store and process your User Content solely for the purpose of providing the service. This licence automatically terminates upon deletion of your content or account.
6.3 Our content
Scriptum, its source code, interface, design, logos, trademarks, texts, images and any other material are the exclusive property of Juan Manuel Cuenca Navarro and are protected by intellectual and industrial property laws.
7. Acceptable use
When using Scriptum, you agree NOT to:
- Use the service for illegal purposes or purposes prohibited by these Terms.
- Generate content that incites hatred, violence, discrimination or that is unlawful.
- Attempt to access unauthorised systems, accounts or data.
- Reverse engineer, decompile or disassemble the software.
- Redistribute, sublicense or resell access to Scriptum.
- Use bots, scripts or automated tools to abuse the service.
- Upload viruses, malware or any malicious code.
- Impersonate any person or entity.
7.1 Acceptable use of artificial intelligence
In addition to the general restrictions above, when using Scriptum's AI features (including Aura AI), you agree NOT to:
- Use the AI to generate content that defames, slanders or injures real individuals, existing companies or organisations.
- Generate content that infringes third-party intellectual property rights, including but not limited to copying, imitating or reproducing copyright-protected works.
- Use the AI to create fraudulent, deceptive or disinformation content, including fake news, identity impersonation or phishing.
- Generate child sexual abuse material, non-consensual pornography or material that sexualises individuals without their authorisation.
- Use the AI to produce spam, low-quality automated mass content, or material designed to manipulate platform algorithms.
- Generate content that constitutes legal, medical, financial or professional advice and present it as such.
- Use the AI to create biological or chemical weapons, instructions for terrorist activities, or any content that facilitates criminal activities.
- Attempt to circumvent the safety filters, moderation or restrictions of the underlying AI providers through prompt injection, jailbreaking or similar techniques.
- Present AI-Generated Content as entirely original human work in contexts where applicable law requires disclosure of AI use (e.g. in literary competitions, academic work or publications with human authorship requirements).
- Share, publish or distribute AI responses in ways that could cause harm to third parties.
Breach of these restrictions may result in the immediate suspension or cancellation of your account without entitlement to a refund.
8. Artificial intelligence service
8.1 Description of the AI service
Scriptum integrates generative artificial intelligence features through its Aura AI assistant and third-party services:
- Web version (SaaS) and desktop version: Aura AI operates on a BYOK basis. The User connects their own API key. In the web version, texts are transmitted through our proxy servers for the sole purpose of forwarding the request to the AI provider chosen by the User (OpenAI, Google Gemini, Groq or OpenRouter) using the User's own key; Scriptum does not store the keys or the content of the requests. The processing relationship with the AI provider is governed by the terms the User has accepted with that provider.
- Desktop version: the User connects their own API keys from AI providers (Anthropic/Claude, Groq, OpenAI, Google Gemini, OpenRouter, or local models). API keys are stored locally on the User's device and Scriptum does not store them on its servers.
8.2 Nature of AI-Generated Content
The User acknowledges and accepts that:
- AI-Generated Content consists of suggestions and assistance tools. It does NOT constitute professional advice of any kind (literary, legal, medical, financial, psychological or otherwise).
- The AI may generate content that is inaccurate, incomplete, biased, inappropriate or factually incorrect (known as "hallucinations"). Juan Manuel Cuenca Navarro does not guarantee the accuracy, truthfulness, quality, originality or suitability of any AI-Generated Content.
- The AI may produce similar or identical results for different users who provide similar instructions. This does not imply plagiarism, but rather the probabilistic nature of language models.
- AI-Generated Content may contain elements that coincide with pre-existing copyright-protected works, unintentionally and as a result of the training data of the models.
8.3 User responsibility for AI-Generated Content
The User is the sole and exclusive party responsible for all use they make of AI-Generated Content. In particular:
- Mandatory review: the User MUST review, edit and validate all AI-Generated Content before publishing, distributing or using it in any way.
- Originality verification: it is the User's sole responsibility to verify that AI-Generated Content does not infringe third-party intellectual property rights before publishing it. The use of plagiarism detection tools is recommended.
- Accuracy verification: if AI-Generated Content includes data, facts, quotes, historical references or technical information, the User must independently verify its accuracy.
- Regulatory compliance: the User is responsible for complying with all laws and regulations applicable to content publication, including but not limited to AI regulations (such as the EU AI Act), copyright, data protection, defamation and consumer protection.
- AI use disclosure: in jurisdictions where the law requires disclosure of AI use in published content, the User is responsible for making such disclosure.
- AI-based decisions: the User must not make important decisions (legal, medical, financial, personal) based solely on AI-Generated Content.
8.4 Intellectual property of AI-Generated Content
- Juan Manuel Cuenca Navarro does not claim any ownership rights over the AI-Generated Content that the User obtains through Scriptum.
- The ownership of intellectual property rights over AI-Generated Content is subject to the applicable law in each jurisdiction, which may vary and is constantly evolving. Juan Manuel Cuenca Navarro does not guarantee that AI-Generated Content is eligible for copyright protection in the User's jurisdiction.
- The User assumes full responsibility for determining the legal protectability of AI-Generated Content in their jurisdiction.
- If the User combines AI-Generated Content with their own original creation, the rights over the User's original parts remain entirely with the User.
8.5 Disclaimer of liability for AI
To the maximum extent permitted by applicable law:
- Juan Manuel Cuenca Navarro shall NOT be liable for any damage, loss, claim or harm arising from the use, publication or distribution of AI-Generated Content, including but not limited to: copyright infringement claims, defamation, reputational damage, financial losses, damages arising from inaccurate information, or any other direct or indirect damage.
- Juan Manuel Cuenca Navarro does NOT guarantee the availability, continuity, speed, quality or suitability of the AI service, which depends on third-party providers subject to their own terms of service.
- Juan Manuel Cuenca Navarro does NOT control or moderate responses generated by AI models. Content filters are applied by the AI providers chosen by the User under the BYOK model (OpenAI, Google Gemini, Groq, OpenRouter, Anthropic) in accordance with their own policies.
- The User accepts that AI providers may modify, update or discontinue their models or services at any time, which may affect Scriptum's AI features without giving rise to any claim against Juan Manuel Cuenca Navarro.
8.6 Data and privacy in the AI service
- When the User uses Aura AI (web version), the text submitted to the assistant is transmitted to the AI provider chosen by the User via our proxy servers, using the User's own API key (BYOK model), for the sole purpose of generating the response.
- Juan Manuel Cuenca Navarro does NOT store, log or retain the content of AI conversations beyond the time technically necessary to process each request.
- We do NOT use the User's content to train, fine-tune or improve AI models, nor do we permit AI providers to do so with data processed through Scriptum.
- Third-party AI providers, contracted by the User themselves under the BYOK model, process data according to their own privacy policies. The User may consult: OpenAI, Google (Gemini), Groq, OpenRouter, Anthropic.
- The User must not submit sensitive personal data, confidential third-party information or legally protected material to the AI services.
8.7 Compliance with the EU AI Act
Scriptum is classified as a limited-risk AI system under Regulation (EU) 2024/1689 (AI Act). In compliance with that regulation:
- We inform the User transparently that Aura AI uses generative artificial intelligence systems to produce textual content.
- AI-Generated Content is not presented as exclusively human creation when the User interacts with the assistant (the interface clearly indicates that it is an AI assistant).
- We do not use high-risk or unacceptable-risk AI systems as defined in the Regulation.
9. Service availability
- We strive to keep Scriptum available 24 hours a day, 7 days a week.
- We do not guarantee uninterrupted availability of the service.
- We may carry out maintenance tasks requiring temporary interruptions, notifying in advance where possible.
- Offline features (editor, World Bible, Planning Board) work without an internet connection.
- AI features require an internet connection (except local models in the desktop version).
10. Limitation of liability
To the maximum extent permitted by law:
- Scriptum is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied.
- We do not warrant that the service will be error-free, secure or uninterrupted.
- We shall not be liable for indirect, incidental, special, consequential or punitive damages.
- Our total cumulative liability shall not exceed the total amount paid by the User in the 12 months preceding the event giving rise to the claim.
- Specifically in relation to AI: we shall not be liable for any damage arising from AI-Generated Content, including but not limited to: intellectual property infringement claims, defamation, inaccurate information, commercial losses arising from reliance on AI, reputational damage, or any consequence of the use of AI-Generated Content by the User or third parties.
- We shall not be liable for the interruption, modification or discontinuation of AI services by third-party providers (Anthropic, Groq or others).
Exception: Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be legally excluded. Likewise, nothing in these Terms purports to exclude or limit consumer rights that are non-waivable under applicable law.
11. Indemnification
You agree to indemnify and hold harmless Juan Manuel Cuenca Navarro, its representatives, employees and collaborators from any claim, damage, loss, liability or expense (including reasonable legal fees) arising from:
- Your use of Scriptum in breach of these Terms.
- Your User Content that infringes third-party rights.
- Any unlawful activity carried out through your account.
- The publication, distribution or use of AI-Generated Content without the proper review, verification or compliance with the obligations set out in Section 8.3 of these Terms.
- Third-party claims arising from content you publish, whether created by you, generated by AI, or a combination of both.
- Breach of any applicable law or regulation in connection with the use of AI or the publication of content.
12. Dispute resolution
We will endeavour to resolve any dispute amicably. If this is not possible:
- EU users: you may use the European Commission's online dispute resolution platform: https://ec.europa.eu/consumers/odr
- Jurisdiction: these Terms are governed by Spanish law. For any dispute, the parties submit to the Courts and Tribunals of Castellón de la Plana, Spain.
- Users outside the EU: the mandatory consumer protection provisions of your jurisdiction shall apply, without prejudice to the application of Spanish law.
13. Modifications
We reserve the right to amend these Terms at any time. We will notify you of significant changes with at least 30 days' notice by email. Continued use of the service after notification constitutes acceptance of the new Terms.
If you do not accept the new Terms, you may cancel your subscription before they come into effect.
14. General provisions
- Entire agreement: these Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Juan Manuel Cuenca Navarro.
- Severability: if any provision is found to be invalid or unenforceable, the remainder shall remain in force.
- Waiver: failure to exercise a right does not constitute a waiver of that right.
- Assignment: you may not assign your rights or obligations without our prior consent.
